4. Takedown and Counter-Notification

Upon receipt of a valid DMCA Takedown Notice, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material. We will also notify the user who posted the content that the material has been removed.

If you are a user and believe that your content was removed as a result of a mistake or misidentification, you may submit a Counter-Notification. Your Counter-Notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  •  A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA Takedown Notice.We may replace the removed content and cease disabling access to it in 10 to 14 business days following receipt of the Counter-Notification, unless our Designated Copyright Agent first receives notice from the person who submitted the original DMCA Takedown Notice that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our Website.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, REFE JOB has a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
